BRANCH COUNTY LAKES WATER LEVELS

Branch County lakes that are fed by streams or rivers are less likely to be affected by drought conditions.  In 1964 Gilead Lake suffered a unique drought condition. It is considered a "land locked" lake so it suffered more than others during the 2-3yr drought in the 60's.  The economic strain it put on the area was immense.  Little can be done about conditions like this one, because the options are so costly.  It's fortunate that it's been over 40 years and we haven't seen such severe conditions.  The water levels never seems to be a continual issue only an intermittent one, and never critical.  This year we have not had the rainfall necessary to keep the water levels high, so some areas are experiencing lower than normal levels, but I haven't heard any complaining.

MICHIGAN BUILDERS- Is your builder licensed in the State of Michigan?

To stay out of trouble make sure you have a written contract and are dealing with a licensed Michigan builder. If not, you may be in court for years trying to settle the dispute.   In a recent 7 year court battle, concerning a property on Lake George, a non-licensed builder had a verbal cost plus arrangement on the construction of a new home.  The costs exceeded the original agreed amount $668,000 by ~$320,000. Resulting in a final cost of $970,000.   The owners had to finish the house with another builder and were awarded judgement against the original contractor in excess of $400K.  http://www.michbar.org/opinions/appeals/2005/031505/26658.pdf

The Michigan Construction Lien Act gives subcontractors a powerful remedy to force payment by an owner, even though the owner has no contract with the subcontractor. The subcontractor can place a lien on the owner's real property and--in the event the owner fails to pay for services or labor--the subcontractor can foreclose the lien and cause a sale of the property. Michigan case law and statutory law strongly suggest that, absent claims arising out of direct dealing between the subcontractor and owner, these lien rights are the subcontractor's sole remedy against the owner, and quantum meruit claims by the subcontractor against the owner are generally not valid. The residential builders act, MCL 339.2412, bars an unlicensed builder from seeking compensation on a residential construction contract. Stokes v Millen Roofing Co, 466 Mich 660, 662, 664; 649 NW2d 371 (2002); HA Smith Lumber,[& Hardware Co v Decina, 258 Mich App 419, 436; 670 NW2d 729 (2003)vacated in part on other grounds, ___ Mich ___; 689 NW2d 227 (2004)]. This prohibition extends to counterclaims as well as complaints, and includes damages for labor and materials, enforcement of a construction lien, and equitable relief.4 Stokes, supra at 665-667, 673; Parker v McQuade Plumbing & Heating, Inc, 124 Mich App 469, 471, 335 NW2d 7 (1983). The prohibition also applies to suits between subcontractors and contractors. Utica Equipment Co v Ray W Malow Co, 204 Mich App 476, 477-478; 516 NW2d 99 (1994). FORCLOSURE- Willowbrook property going to Sheriff sale.

Forclosures are up as reported by Century 21 Drews Realty.  Property located on North Willowbrook is scheduled for sheriff sale on August 9, 2007 at the Branch County Court house.  Forclosure amount is estimated at over $3M. This site was to be used for a proposed waterpark that never happened.  James DeMaria, Broker, was the developer on this project.  From all reports it's unclear why the proposed plan ended in forclosure.  He had a similar plan in Florida for a proposed waterpark, and I can not confirm if that plan fell short as well.
